1. Who we are and these Terms

1.1 These Terms of Use ("Terms") are between you and LoopDesignLab PTE. LTD., a company registered in Singapore, of 83B Tanjong Pagar Road, Singapore 088504 ("LoopDesignLab", "we", "us"). We design the loop, have it manufactured and own the software on it. These Terms cover your use of the loop (which means the loop and the loopTwo, our portable 5G Wi-Fi devices with a camera, screen and speaker) and its software, and apply from when you set up or first use it.

1.2 Your loop is sold to you by the retailer you bought it from (a LoopDL company or another shop), under that retailer's terms of sale. Your legal rights if the loop is faulty, your right to cancel an online purchase, the seller's guarantee and any plan you use with it are covered by the seller's terms, not these Terms. 1.3 Apps, plans and services you use with the device have their own terms. The device's privacy policy explains how your data is used.

1.4 If you are a consumer, nothing in these Terms reduces the rights you have under the consumer law of the country where you live.

2. Using the device and the software licence

2.1 You may use the loop and its software for your own lawful, personal use. You are responsible for keeping the device, its passwords and your accounts secure.

2.2 We grant you a personal, non-exclusive licence to use the software on the loop, only as part of the device, for as long as you own it. If you pass the device to someone else, the licence passes with it. We and our licensors keep all rights in the software. Open-source parts are licensed under their own terms, shown in the device settings.

3. Apps and third-party services

3.1 Third-party apps and services on the device are provided by others under their own terms; we are not responsible for them.

4. Acceptable use

4.1 You must not use the loop for fraud or any unlawful, harmful or infringing purpose; tamper with, bypass or disable its security features; or reverse engineer, root, re-flash or modify its software in a way that defeats its security, except to the extent the law allows.

4.2 Such changes can stop security updates working and make the device unsafe. A fault caused by them is not covered by the seller's guarantee; your legal rights for any other fault are unaffected.

5. Software and security updates

5.1 The loop receives software, firmware and security updates. Some are needed for security or to keep the device working and may install automatically.

5.2 The minimum period for which we provide security updates for the device is published on the LoopDL website. We may extend this period but will not shorten it.

5.3 An update will not make the software stop meeting the standards your local law requires.

6. Mobile connection

6.1 Any mobile or data service you use with the device is provided by your provider under its own terms.

6.2 If the device is data-only, it cannot make calls or contact emergency services (999 or 112); keep another way to contact them.

7. Safety, care and recycling

7.1 Follow the safety information supplied with the device.

7.2 Do not throw the loop or its battery away with household waste. Contact the seller and it will tell you how to recycle it, or take it to an electrical-waste collection point.

8. Your legal rights

8.1 If you are a consumer, the loop must be of the quality, fitness for purpose and description your local law requires, and so must its software. If it is not, you have the remedies your local law gives you against the retailer that sold it to you, such as repair, replacement, a price reduction or a refund. The seller's guarantee is in addition to those rights.

9. Our responsibility to you

9.1 We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable, for third-party apps, services or networks, or for loss of data we did not cause; back up regularly.

9.2 We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, for defective products, or for breach of your rights as a consumer.

9.3 The loop is for domestic and private use. If you use it for business, we are not liable for loss of profit, business, business interruption or business opportunity, and our total liability is limited to the price paid for the device.

10. Changes to these Terms

10.1 We may change these Terms to reflect changes in the law, for security reasons, to reflect changes to the software or our services that do not materially reduce what the device does, or to make minor or clarifying changes. For a material change we give at least 30 days' notice on the device or in its app where we can. The current version is at docs.loopdl.info/loop/ts-and-cs.

11. Law, disputes and contact

11.1 These Terms are governed by the law of Singapore. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts of that country.

11.2 If you have a problem with the device software, contact us first and we will try to resolve it. Complaints about a plan, device or service you bought go to the company that sold it, under its complaints process.
