LoopKey - App Terms and Conditions

These are the App Terms and Conditions under which LoopDesignLab PTE. LTD. provides the LoopKey application (the 'App') to you. These App Terms supplement, and should be read together with, the LoopPhone Terms of Use and the LoopKey Privacy Policy.

About These App Terms
1.1. These App Terms apply to LoopKey, a system app pre-installed on your LoopPhone that carries out device locking and management.
1.2. By setting up or using the device you accept these App Terms, alongside the LoopPhone Terms of Use.
1.3. We may amend these App Terms from time to time; the updated version will be made available on the device and at docs.loopdl.info/loopphone/apps/loopkey/terms-and-conditions, and we will give you notice where required.
1.4. Nothing in these App Terms affects your rights under the Consumer Protection Act 68 of 2008.

Pre-installed App and Google Play
2.1. LoopKey is pre-installed on the LoopPhone and is distributed and updated through the Google Play Store for LoopPhone devices. You cannot fully uninstall the version built into the device, but you can uninstall Play updates to revert to it.
2.2. These App Terms are between you and LoopDesignLab PTE. LTD. only, and not with Google LLC; LoopDesignLab, not Google, is responsible for the App; and Google has no obligation to support it or address claims relating to it. The App may be published and distributed on the Google Play Store by LoopDL Limited, a member of the LoopDesignLab group, on behalf of LoopDesignLab; these App Terms remain between you and LoopDesignLab PTE. LTD.

Licence to Use the App
3.1. Subject to these App Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the App as part of your LoopPhone.
3.2. You must not disable, bypass, tamper with or circumvent LoopKey or the locking it manages, and you must not reverse engineer it except to the extent the law permits. The App and all intellectual property rights in it remain the property of LoopDesignLab and its licensors.

What LoopKey Does
4.1. LoopKey carries out device locking and management on your network provider's instruction. Your network provider decides whether to lock or unlock the device; LoopDesignLab does not make that decision - LoopKey only carries out the provider's instruction.
4.2. The device may be locked, or have functions limited, for: non-payment under a finance, instalment or service arrangement; fraud; or a report that the device is lost or stolen.
4.3. Emergency calls always remain available, even when the device is locked, where the network supports them. A lock may restrict access to apps and most functions.
4.4. LoopKey uses only the lock status and the limited device identifiers needed to manage the lock. It does not access your personal content (messages, photos, files).
4.5. Resolving a lock. Because your network provider decides locks, any notice or opportunity to put things right before a lock, and any request to unlock or dispute a lock, are handled by your network provider. Contact your network provider - account matters are in the LoopPhone app.

App Updates
5.1. We may provide updates via Google Play, which may be required for security or continued operation. We may discontinue support for older versions.

Accounts
6.1. LoopKey does not have its own account or sign-in; it operates at the device level on your network provider's instruction.

Data and Privacy
7.1. The data LoopKey uses is set out in the LoopKey Privacy Policy.

Our Responsibility (Limitation of Liability)
8.1. Nothing in these App Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, fraud, or your non-excludable consumer rights). Subject to that, our liability is limited to the maximum the law allows.

Your Consumer Rights
9.1. Nothing in these App Terms reduces your rights under the Consumer Protection Act 68 of 2008, which prevail over any conflict.

Governing Law and Contact
10.1. Governed by Singapore law, except where South African law gives you local rights. Contact: legal@loopdl.com.
