LoopPhone Terms of Use

1. Who we are

   These Terms of Use (“Terms”) are between you and LoopDesignLab PTE. LTD., incorporated in Singapore (reg. no. 202334183H), 83B Tanjong Pagar Rd, Singapore 088504 (“LoopDesignLab”, “we”, “us”). LoopDesignLab is the manufacturer and supplier of the LoopPhone. We are not your network provider - mobile network, calls, messaging and data are provided separately by your network provider. The device is manufactured in China for LoopDesignLab. By setting up or using the device you accept these Terms.

2. Using the device and the software licence

   You may use the LoopPhone and the LoopDesignLab software on it for your own lawful, personal or internal business use. You are responsible for keeping your device and accounts secure. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the LoopDesignLab software on the device, solely as part of the device. We and our licensors retain all intellectual property rights in it. Your statutory rights are not affected.

3. Pre-installed LoopDesignLab apps

   The LoopPhone comes with three LoopDesignLab apps - Glance (manages the content on your back screen), LoopPhone (lets you personalise your phone, manage your settings and configurations, and buy additional services), and LoopKey (carries out device locking and management on your network provider's instruction). What data these apps use is set out in the Privacy Policy and, for each app, its own app privacy policy where it has one.

4. Acceptable use - things you must not do

   • Use the device for fraud, or for any unlawful, harmful or infringing purpose.
   • Tamper with, bypass or disable the device-management, locking, network-lock, connectivity-management or security features.
   • Reverse engineer the software except to the extent the law allows; make unauthorised modifications, root or re-flash in a way that defeats security; or redistribute the software separately from the device.

   Some modifications can stop security updates working, may make the device unsafe, and may affect your warranty for the affected fault. Your non-excludable statutory rights still apply.

5. Software and security updates

   The device receives operating-system, firmware and security updates; some are required for security or compliance and may install automatically and may use mobile data. Back up before major updates. LoopDesignLab provides operating-system and security updates for a minimum of two years from your date of purchase, or any longer period required by law.

6. Third-party apps and Google services

   Third-party apps and services are provided by others under their own terms; we are not responsible for them. The device includes Google Mobile Services and the Google Play Store, provided by Google LLC, not LoopDesignLab, under Google’s terms, which you accept with Google.

7. Connectivity, device management, network lock and locking

   Network service is provided by your network provider under a separate agreement; we are not responsible for coverage, charges or your provider’s acts. Your network provider may in some cases be a member of the LoopDesignLab group (for example, for Travel eSIM services).

   Managing your connectivity. To provide the service, the LoopDesignLab software may carry out connectivity actions on your network provider’s instruction - including selecting and switching between SIMs based on network conditions, installing, removing or enabling eSIM profiles, setting default SIMs and configuring network settings, applying network branding, running connection and speed tests, and (where supported) performing remote actions such as a restart to keep the service working.

   Network lock and device locking. This device is network-locked, and it may be locked or have functions limited for non-payment, fraud, or loss or theft. Your network provider decides whether to lock or unlock the device; LoopDesignLab does not make that decision - the LoopKey app, pre-installed on the device, only carries out the provider’s instruction. Emergency calls always remain available, even when the device is locked, where the network supports them. Full detail is in the LoopKey App Terms.

   Reasons a device may be locked: non-payment under a finance, instalment or service arrangement; fraud; or a report that the device is lost or stolen.

   Your data when locked. Locking uses only the status and limited identifiers needed to manage it, and does not access your personal content (messages, photos, files).

   Network lock and unlocking. At launch the device works only with the SIM or eSIM of your designated network provider until it is unlocked. Unlocking is controlled by, and follows the process of, your network provider.

   Resolving a lock. Because your network provider decides locks, any notice or opportunity to put things right before a lock, and any request to unlock or dispute a lock, are handled by your network provider. Contact your network provider - account matters are in the LoopPhone app.

8. Warranty

   LoopDesignLab warrants the LoopPhone against defects in materials and workmanship under normal use for 12 months from your date of purchase. Valid proof of purchase is required. This warranty is in addition to, and does not limit, your statutory consumer rights under the laws of the country where you bought the device.

   • Covered: defects in materials or workmanship, including the built-in battery, under normal use. There are no in-box accessories.
   • Not covered: accidental, impact or liquid damage beyond the stated resistance (IP64); normal wear and gradual battery capacity loss; faults from unauthorised repair, non-approved parts or modification, or from rooting/modified software; and loss of data.
   • How to claim: contact LoopDesignLab via the LoopPhone app. Repair or replacement is handled by LoopDesignLab, or one of our authorised repair centres. Back up first.

9. Our responsibility to you (limitation of liability)

   Nothing in these Terms limits liability that cannot be limited by law - including death or personal injury caused by negligence, fraud, or your non-excludable consumer rights. Subject to that, LoopDesignLab is not liable for indirect or unforeseeable loss, loss of data not caused by us, or loss from third-party apps, Google services or your network provider; and our total liability is limited to the maximum the law allows.

10. Your statutory consumer rights (local consumer law)

    These Terms are governed by Singapore law (clause 11), but nothing in them reduces any consumer rights you have under the mandatory laws of the country where you bought the device, which prevail over any conflict.

11. Governing law, changes and contact

    Governed by Singapore law and courts, except where local consumer law gives you mandatory rights. We may update these Terms and will make the current version available on the device and at docs.loopdl.info/loopphone/device/terms-and-conditions. Legal: legal@loopdl.com.
